Acceptance of Terms
By accessing or using MagiPack (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
We may revise these terms from time to time. Material changes will be communicated within the application before they take effect. Your continued use of the Service after such changes constitutes acceptance of the revised terms.
Description of Service
MagiPack is an AI-powered visual transformation platform that allows users to modify and enhance photographs, including but not limited to hairstyle changes, colorization, and image enhancement.
AI-generated content is inherently creative and variable. We do not guarantee that the output of the Service will meet your specific expectations, be free of artifacts, or be suitable for any particular purpose.
Intellectual Property
You retain ownership of all original photographs you upload to the Service. By uploading, you grant MagiPack a limited, non-exclusive, royalty-free license to process, transform, and deliver the resulting output to you.
All underlying technology — including models, software, designs, and trademarks — is the property of MagiPack. You may not copy, modify, reverse-engineer, decompile, or attempt to extract the source of any component of the Service.
Prohibited Conduct
When using the Service, you agree not to:
- Upload photographs of any person without their consent;
- Generate content that is defamatory, harassing, sexually explicit, or otherwise unlawful;
- Attempt to interfere with, probe, or compromise the security of the Service;
- Impersonate any individual, organisation, or MagiPack itself;
- Use automated scripts, scrapers, or bulk-extraction tools without prior written consent.
Violations may result in immediate suspension or termination of your account, forfeiture of remaining credits, and referral to the appropriate authorities where applicable.
Credits and Payments
The Service uses a credit system. Credits may be granted on sign-up, earned through promotions, or purchased through the in-app store. Each generation request will display its credit cost before being initiated.
All credit purchases are final and non-refundable, except where required by applicable consumer protection law. Credits have no cash value, cannot be transferred between accounts, and expire upon account closure.
User Content
By uploading content to the Service, you represent and warrant that:
- You own the content or have obtained all necessary rights and permissions to upload it;
- Your use of the Service complies with all laws applicable to you;
- You have obtained parental or guardian consent before uploading any image of a minor under the age of thirteen;
- The content does not contain material prohibited under Section 04.
You accept full responsibility for any content you upload and agree to indemnify MagiPack against any claims arising from a breach of these representations.
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MagiPack disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that any generated output will meet your requirements.
Limitation of Liability
To the maximum extent permitted by law, MagiPack and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total aggregate liability to you, for any cause whatsoever, shall not exceed the total amount you paid to MagiPack during the three months immediately preceding the event giving rise to the claim.
Account Termination
You may deactivate your account at any time through your profile settings. Deactivation will revoke your active session and queue your account for permanent deletion.
MagiPack reserves the right to suspend or terminate any account that poses a legal, security, or operational risk to the Service, with or without prior notice.
Governing Law
These Terms shall be interpreted in accordance with internationally recognised principles of contract law and applicable consumer protection law in your place of residence. Disputes that cannot be resolved through good-faith negotiation will be referred to binding arbitration or competent civil courts, at MagiPack's election.
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
